Oliver Wendell Holmes Jr. was one of the most influential American jurists of the late 19th and early 20th centuries, whose career combined courtroom practice, teaching at Harvard, and a long tenure on the United States Supreme Court. Recognized as a father of Legal Realism, Holmes challenged prevailing formalism by arguing that law should be understood through experience and the prediction of judicial decisions rather than by abstract deduction.

His theoretical work includes The Common Law and the essay The Path of the Law, in which he developed ideas such as the “bad man” theory and a pragmatic emphasis that anticipated later debates on law and economics. These positions influenced reforms in common law interpretation and opened the way for more instrumental approaches to law.

On the Supreme Court he became known as “The Great Dissenter” for notable dissents and for conceptual reexaminations of precedent, shaping decisions on constitutional limits, procedural evidence, and labor issues. Holmes left a lasting legacy in American legal thought and judicial practice, with effects that extended into 20th-century English law.
